Tier 2 Spouse visa, setting up company and maternity leave?

Hi guys,

Quick question here: I am on a Tier 2 Visa sponsored by my employer.

My wife is on a Tier 2 Spouse visa.

She has set up her own HMRC-registered company, a small business.

She is looking to employ 1-2 employees right now, however we have a question:

1.) When and if her employees claim maternity leave, will her company be eligible to claim back maternity leave costs from the government, plus 3%, as mentioned here? -> (http://www.thisismoney.co.uk/money/expe ... lable.html)

For the record, my wife's visa states she has "no recourse to public funds", but I am guessing that only applies to her personally, such as Jobseeker's Allowance, and it should NOT apply to her company, which may very soon be employing 1-2 local British citizens.

2.) Will the maternity leave be applicable to her, too?
