Tier 2 Notice Period and CoS start Date

Hello,

I am wondering if someone senior can clarify or provide some advice please?

Tier 2 Change of Employer

my start date on the CoS 31st Jan 2017.
I have not resigned yet, I have 1 month notice period.
New employer sent application online Friday 6th Jan.

1. I want to know whether it is legal to serve notice period after the start date on CoS is 31st Jan 2017?

para 220. in Tier 2 policy guidance stating that I can work for previous employer until start date on the CoS.
