Permanent Residence application issue

Post by agnesgia » Tue Jan 10, 2017 2:21 pm

Hi everyone,

I have been living in the UK since 2008. Back in early 2015, I have applied for the registration certificate which was granted without any issues. I have realised then that I could have applied for the permanent residence certificate as I have been a resident for more than 5 years. I have sent out an application in October 2015. The application was declined on the basis of me not having an insurance when I was at Uni (2008 - 2011) which is fair enough. The second reason was that they could not get in touch with my previous employer; who by the time of application ceased trading and therefore they could not confirm my employment. I have included all my payslips from that time and a confirmation letter on a letter headed paper issued by the employer when I was still employed by the company. Please note that I was employed from late 2010 so I still qualified for the permanent residence based on that.

Is the above reason a valid reason to decline the permanent residence application? Do I know need to wait additional 3 years to be eligible again?

Welcome.

CSI is a valid reason for failure if you had no alternative.
But maybe you could have found more info about that employment.

What is this "3 years" delay for?
You may not have 3 years to play with what with Brexit looming.

Instead of CSI...
  • Did you have a foreign EHIC?
Did you have as RC issued to you as a student during/before 2011?
Did you have any EU relative in UK at same time who was a qualified person and so could be considered to have been your sponsor?
And have you tried getting more evidence about employment?
  • Tax documents or similar?
If you can pull together better evidence you could look at reapplying and getting back on track.
All that is gold does not glitter; Not all those who wander are lost. E&OE.
