I was wondering if someone could advise me on what to do with my current situation.
I proposed to my girlfriend last year, while she was in the UK under a valid visa, which we then applied for a marriage notice as we thought this would be possible under her visa at the time. The notice of marriage was rejected (as there as insufficient time before the expiration of the visa), so we decided it would be best for her to return home before her current visa expired at the start of this month and then apply for a Fiancé visa (Which we are currently putting together) from her home country (USA).
Since this time, we have received a letter from the home office stating that they would like to investigate the marriage, to ensure that it is not a sham marriage. I have no concerns around the investigation, as we are a genuine couple and have a significant amount of evidence to prove this.
My only concern is; can we still apply for the Fiancé visa during the investigation period? Or do we have to wait until this has finished, then submit her application?
Any help would be greatly appreciated.
