ILR/Settlement for Adult Dependant Relative/Health Surcharge

Dear All,
My mother applied for ILR/settlement as an ADR which was refused. However, our appeal succeeded and the embassy asked us to submit the passport for processing. They are now insisting that she pays Immigration Health Surcharge within 7 days otherwise her application would be refused. We told the embassy that the health surcharge is not payable on ILR/settlement applications but they insist. I checked the rules and they suggest that health surcharge is only payable on limited leave to remain applications/decisions. If anyone can help clarify this point, then that would be very helpful indeed. Kind regards,

If they grant her ILE under D-ECDR.1.1, then

Thank you for your reply. I have paid the charge as the embassy wouldn't process the visa otherwise, and even threatened to refuse. Will try to deal with it when my mum is here. Kind regards,
