Hi,

I'm having the exact situatino, can you be kind enough to provide more detail about the the way to apply for the EHIC? and does it work with your application?

Would really appreicate your reply.

I am an EEA citizen and have been in UK as a student since 2007 to 2014 and then I started working here from May 2014.

I have found in this guide that the SI form can be used as Comprehensive Sickness Insurance. I'm just wondering if anyone know it will work with the permanet residence application and if anyone know how to apply for the S1 form?

Moreover, my mother, as an EEA citizen, has been working in UK since 2002. I have come to UK to stay with her in 2006 and have applied for a residence permit (valid from 2006-2011). I was 21 year old back then and couldn't find a uni for my study, so I left UK to finsih my study and came back to UK in 2007 to study my master.

The home office said that they can accept this residence permit but it fails to privde sufficient evidence that I have remained enconomically active since the date it was issued.

So my question is: can I show that I am economically active if I'm a master student supported by my mother working in UK (2007-2009) and a PhD student with scholarship (2009-2014)?

Would appreciate any advice on these two questinos. Thanks.

When did you arrive in UK (in 2006)?
What did you do and how long did you stay?
Were you under or over 21 in 2006?
How long were you abroad in uni? (how many months)

You can be a family member financially dependent on mom, even if over age 21, if you can show you were dependent on sponsor for essential daily needs.

You can be considered a student qualified person in your own right if you had CSI (or alternative);
or a foreign-issued EHIC;
or a RC issued to you as a student during/before 2011.

I arrived in UK in January 2006 at the age of 20, right before my 21st birthday. I was born in February 1985.

My mum was working here and I came to UK for 2 months, to apply for the residence card and to look for the possibility to study here. However, we found out that it would be really hard to transfer to UK to continue my bachelor degree, so I left UK for 18 months to finish my degree before coming to UK in August 2007.

From August 2007 till April 2009, I was living with my mum in London and complelety dependent on my mum. In May 2009, I got a scholarship and moved to my Uni to conintue my PhD study, during that time i was only partly dependent on my mum. I'm not sure if I can calculate the 5 year residdence from 2006 January - 2011 January.

I think i should have a better chance to apply as a student qualified persion. I didn't have the EHIC, can I apply for one now to cover those past period? and what does RC means?

RC = Residence Certificate.

By leaving UK for 18 months you broke any initial continuity of residence.

Your PR clock started in 2007.
You can possibly combine time sponsored by
mom then as a qp in own right.
Or mom could have continued with a level of support up to 50%.

You can't backdate CSI as its a form of insurance.

Actually, my mom got a stroke in July in 2012 and my scholarship finished in 2012, and I moved back home in 2013 to take care of her and finish my thesis. We got a lot of difficulties in those two years and we are dependent on each other. I have those letters about her sickness, bills about the household expense and those document about how i involved in her rehabilitation.

I think I will apply as my mum's dependent (or carer?) from July 2012 - April 2014, and then as a QP in own right from May 2014 - July 2017.

So I can just put in one application with a cover letter to explain the situation, right?

To apply as dependent you have to prove you were financially dependent on mother/sponsor.
Unclear how that's possible if she was ill and you were her carer.

If mother/sponsor has ceased all activity due to illhealth you may have a case under EEA Regulation 5.
