What will happen next?

Post by AnonAnonymous » Mon Jan 23, 2017 5:18 pm

So my hubby is illegal, we have a baby and went through the solicitors who submitted an application under 'family' visa. He has had his biometrics done, and has paid the £500 NHS fees, what will happen now? The application was submitted in Nov 2016, would they ask for DNA of my hubby and our child? A bit apprehensive about it all!

Sorry, yes. Partner route. We're married, with a baby and living together.

In which case the HO shouldn't request a DNA as your husband will automatically be considered to be the father of your child.

It's simply a waiting game now, but it may take some time for a decision to come through.

I'm assuming that the HO agreed your relationship is genuine and finally gave you permission to marry?

Great, thank you for your response. Feels like we're waiting forever! Actually very worried about what their decision is going to be.

How old is your baby?

Unfortunately believe it or not the home office do not see babies as a strong tie for the spouse to stay

We were refused flr (fp) attended an appeal where home office said baby was young enough to adapt in a foreign country and won on appeal.

Some questions
When did you marry and was it an official marriage with documentation?
Where did you marry UK or elsewhere?
How old is the baby?
How did your husband enter the UK - was in originally by legal means?

With answers to the above it is inform a better prediction of the outcome.
