British citizenship for BPP British Protected Person

Post by crazyflower » Thu Jan 26, 2017 6:13 am

I was born as a british citizen with both parents british in Uganda in 1962. But with Idi Amin we went to India. My parents had to give up their British citizenship and I have an Indian passport now.
Now with the immigration rules changing, I would like to know if I have any automatic claim to British citizenship as
1. at birth both my parents were british. father naturalised and mother had a registration certificate.
2. My parents were born portuguese before they obtained british citizenship .
3. Now that BPP are eligible for full citizenship do I stand a chance.I live in Hong Kong for last 25 years.
4. Can I transfer it to my husband and daughter, as it is by descent right?
Thanks in advance. Is it worth going in this direction.

Were your parents BPPs or CUKCs? BPP status is lost if the person acquired any other nationality. If your parents and you acquired Indian citizenship, their and your BPP status would have terminated.

Where and when was your father naturalised? Where and when did your mother register?

You are probably better off looking at acquiring Portuguese citizenship and then moving to the UK using EU freedom of movement before Brexit.

Thank you Secret Simone.
1. My father was naturalised in Uganda as it was a British Colony then.
2. My mom was registered as she married my Dad. Don't have dates off hand. But in 1960s.
3. My Dad in 1952. Then bcos of Ugandan Independence in october 1962, my Dad became a Ugandan , had to renounce his british citizenship and Mom retained. Not relevant to me at birth but to my other siblings.
4. Idi Amin in 1972 made us refugees, my father lost his ugandan, mom had to give up british as we moved to India. I at 18 became Indian.
5. They were CUKCs as I can see from their certificates long ago.

what form should I apply on? I had written a letter in 2010 to Liverpool and they did say I stand a chance. Now I am 54.and would like to know if I can take my husband with me and if my daughter is eligible, if she is more than 21 years.
Please any advise would help. Also with brexit coming, I don't know if I should try for the portuguese one, or will it be repeat of Idi Amin once again.
Thanks in advance.

CUKCs who were not connected to the UK itself (as opposed to the colonies) by birth, by descent from a parent born in the UK or by being naturalised or registered in the UK, became British Overseas Citizens in 1983.

Most people from Uganda (and other colonies) who had retained their British citizenship became British Overseas citizens in 1983, which does not give them the right to live in or work in the UK.

People who held only BOC citizenship but have never held any other nationality can register as a British citizen. But as you acquired Indian citizenship, you can not register for British citizenship now. You are most likely a BOC citizen as well, but India will terminate your citizenship under Indian law if you apply for a BOC passport. The BOC citizenship is a strange form of citizenship in that it does not give you the right to reside in any country in the world.

So, you are better off holding onto your Indian citizenship and exploring the Portuguese citizenship route.

If you acquire Portuguese citizenship, you can reside in any EEA country, including the UK before Brexit. Ireland, Cyprus and Malta are three Anglophone countries in the EEA that you and your family can reside in. Furthermore your right to bring your family to Europe are more extensive under EU law than UK law. I suggest that you pursue that option.
