Set (LR) 10 yr query - when can i apply confusion

Post by ukpostgrad1 » Fri Jan 27, 2017 9:22 pm

Hi Guys,

im confused about qualifying period ie i got visa in 27/2/2007 however arrived in uk on 27/4/2007 so when can i apply for set(LR) on homeoffice website its confusing - it states

4. When to apply
You should apply before the end of your permitted stay in the UK.
There is a qualifying period to complete for a Long Residence application It runs either from

A the date on which you entered the UK with a visa;

or, if you did not enter the UK with such a visa, from

B the date on which you were first granted permission to remain in the UK.

If you entered the UK with a visa several weeks or more after the date from which it was valid for
use, you may need to apply for an extension of stay to complete the relevant qualifying period.
Please do not apply more than 28 days before completing the qualifying period. If you apply earlier
than that, your application may be refused. If that happens, we will not refund the fee and you will
have to pay again when reapplying.

solicitors giving mixed feedback. pl can someone help

You can apply no earlier than 28 days before the 10 year qualifying date of 27.04.2017

Thanks Buddy,

My confusion is with the point B

B the date on which you were first granted permission to remain in the UK.

Is there anyway i HomeOffice can take my date of approval ie. 27/2/2007 to count towards my 10yrs of residence?

Many Thanks for your help in advance

But B only applies if: you did not enter the UK with such a visa!

....and no, because you didn't start to reside in the UK on 27/2/2007
