T2 dependant ILR status linked to Tmain applicant settlement

Post by funnyuser » Mon Jan 30, 2017 11:14 pm

Hello,
Hope you are fine. I would like to have some clarifications regarding tier 2 dependents( Son - 20 Months old) to be eligible for settlement.

I have the following query and it will be of immense help if the question can be answered.

My Husband (Main Applicant) planning to apply for ILR via the Tier 2 (General) -5 Year continuous residence in FEB 2017.

My minor son(born outside UK) is on Tier 2 Dependent visa (Tied to Husband's T2 main applicant) issued in July 2015 and has been living in UK

for the last 1 year and 7 months. His dependent visa will expire March 2018.

What will happen to the status of my minor son? Will he have to change from Tier 2 Dependent visa as my Husband (main applicant) planning to apply for ILR or can continue on the same Dependent visa?

The mother of the child (myself) is on a separate Tier 2 General visa.
Any help on this regard will be highly appreciated. Thanks in Advance

Son may continue to extend under 319H. He may apply for ILR under 319J when both parents are eligible for, or have, ILR.
