Hello All,

In need of some serious advise i am currently on a Tier 5 working holiday visa for 2 years from Australia/New Zealand.


I got into some trouble with a incident which i had to go to court for and the outcome wasn't favourable resulting in me getting a criminal conviction for two charges. This was June 13 2016 so it will be spent in 2017 June 13.

At this point in time my new employer that a friend got me a job with is till willing to do sponsorship but i am scared i will be eligible for this visa because of m conviction. It was my first time in court so so all a new experience but i was issued with a Fine both charges.

I need some serious help will i get rejected i was reading someone it has to be spent for two years is this correct. I was looking at getting a immigration agent to assist with a application and give me advise or will it not matter.

Anyways i am frekaing out as my visa expires in May 7th will i be better to apply for it when outside of the country and after the conviction is spent. I have nothing else happen and i had a bad judgement call in a situation. Family death anniversary was a factor into something out of the character for myself.

Some points to consider
You have to apply for Tier 2 visa outside of the U.K. in any event. You can not switch from T5YMS to Tier2 in country. So you are returning home regardless if you are considering returning under tier 2.

The issue of your criminal record - as long as you declare it at the visa application stage it should not be much of a barrier. Without the full facts it is impossible to say how much of an issue it could be.

The biggest hurdle is the fact that your current employer has no licence and will struggle to get one. Given the circumstances you have outlined it will be refused.

Hello Thanks for replying

So the record will not affect the decision? I actually been in contact with a immigration agent they will do all the paper work necessary to get the licence apply for my licence.

So the issuse is going to be the criminal conviction. I have a quote from the immigration with what work they do etc.


Yes i do have to be out of the country i think i need to go back to home country. I mean i would prefer to go somewhere closer then Australia to do my biometrics etc.
