Hello ImmigrationBoard,

Summary: I have been with the same employer and had to work overseas for an year. I returned to the UK 3 months back for the same employment. I have an ILR and am applying for Spouse’s 'family of a settled person’.

Advice required on: whether or not I am eligible for Category B, Variable Pay

Details: Since I was paid differently in overseas(gross monthly salary was £1000), I am not able to meet the minimum annual salary of £18,600.
So I will have to wait for 3 more months to meet Category A requirement, when salary for each of the previous 6 months will be above required minimum.
Alternatively, I could apply under Category B, Variable Pay, which has below 2 conditions to it:
1) Gross annual salary since I returned to the UK is £50,000. So at the date of the application, my Gross annual salary will be above the required minimum.
2) Total Gross salary of the 9 months Overseas (converted into GBP) and the UK salary for the last 3 months is £22,000. So in the past 12 months prior to the application, income from employment (both UK and Overseas) is more than £18,600.

Can I be considered for Category B Variable pay? If yes, is the success rates of this category relatively less compared to Category A? In which case, I would prefer waiting for 3 more months and applying under Category A.
