Extension, salary & working hours

Post by mrbojangles » Mon Feb 06, 2017 1:49 pm

Hello all,

This is an enquiry for an extension of a tier 2 visa in SoC 3545.

Required salary is £32,500 for an experienced worker based on a 39 hour week. Actual salary is £30,000 based on a 40 hour week, so not quite enough. Clearly the preferred solution would be to negotiate the salary upwards, but would it be equally acceptable to ask the employer to increase working hours? A 43 hour week would bring the pro rata salary up to the required level.

Many thanks for any advice.

u need to reduce hours, not increase it. Increasing will mean u get paid even less.
just by reducing your hours and not rest of the company would be illegal and your sponsor could get caught on this

Can I ask something else?

I have a note from the previous application that the increased salary only needs to be paid after the extension is granted, not at the time the application is made. Is this correct?

Thanks again.

They will look at what the employer has stated what they will be giving from the start date of the cos. which means yes in future.
However, if they say one thing and do the other.. and UKVI come for a visit, their licence can be revoked and your visa curtailed.

OK, thanks iworker. The employer seems to be playing fast and loose with this, and for the sake of saving a few hundred pounds by delaying the pay rise for a couple of months, is taking quite a risk it seems.
