Tier 1 Ent Employee Issue

Post by dontworry » Sun Feb 12, 2017 10:14 am

Hi Members,
Thanks everyone for wonderful help providing through website, I am applying for my Extension in June 2017.
I have got 2 full time employees and one Part time apprentice on Saturday.
My Problem is I had an employee from 15th May 2016, he stopped coming to office on 17th of August. During the time he earned £4291, i could only find a replacement person by 1st of September. We didn't have any one in that for 2 weeks. Will that be a problem ?

Please help .

Many Thanks in Advance
Mathew

A single job need not consist of 12 consecutive months (for example it could exist for 6 months in one year and 6 months the following year)

Correctly said by Zimba88. The only thing I will add to this is to check the post transitional arrangement (employee requirements for visas approved after 6 April 2014) on the Tier 1 ent policy guidance as I think you have secured your visa after 6 April 2014.

Best regards

The transitional arrangements are irrelevant here. A job period does not need to be continuous

Thanks for replies,
I think i need to explain my situation little more detailed. I Run a small IT support Business for Small business and Home Users.

Employee 1 From 2014 as Manager.
Employee 2 from Mid May 2016 as Receptionist, but the guy stopped coming on 17th August. Found a replacement person on 1st of September. so technically i didn't have any for that 2 weeks period.

2nd Job I am hoping I could Claim 12 months from 1st June 2016 to 1st June 2017 but now it is incomplete for 2 weeks. Monthly 170 Hours.

Hope this helps

Many Thanks

You cannot. You should let the employee work until the end of June 2017 to cover the two weeks

No, hours worked over 30 will be ignored. When did you apply for your visa initially ??

In your case two jobs each min lasted for 12 months (not continuously though), otherwise your extension will be refused
