urgent advice needed loss of job before FLR(m) application

Post by fn286 » Thu Feb 16, 2017 12:21 am

Dear Moderators and senior advisors

I urgently need advice. What happens if the sponsor (British) who has been earning very high salary since last few years loses job just before the spouse visa extension (FLRM) is due or loses job on the day of premium services appointment at Croydon?

If someone has all the documentation from the X-employer such as employment letter confirming salary, job start date and permanent employment status and salary slips, can he still apply for FLRM using these documents or will the FLRM application will be rejected?

Will the home office will reject the FLRM even if the person has earned over £55000 in last 12 months, but no longer employed at the time of application?

I really need to know what will be happen if the FLRM application is rejected? will there be any right to appeal or submit new employment/self employment documents? What if the sponsor start own business or secure another job after the application was rejected?

Please please advice urgently.

Thanks.

If you propose to inform them that the person has lost their job, then the requirement of Appendix FM is unmet.

Category B will only be engaged if you have a current job on the day of application, which meets the financial requirement, and 55k has been earned in the 12 months leading to the application, and that a job which meet the current requirement is held.

Dear Obie

Please can you confirm that my FLR(m) will not be granted if the sponsor doesn't have a job on the day of application, even if the actual income from last 12 months is much higher than £18600?

and if the FLR(m) is rejected, will the home office will grant right to appeal or apply again if sponsor secure new job or become self employed?

will it be a huge mistake applying for FLR(m) thinking that £55000 earned in last 12 months will be enough to meet the financial requirement?

Thanks.

Dear Obie,

do you think its better idea to withdraw the FLR (m) application and apply after securing new employment or self employemnt?

Thanks.
