Tier 2 ICT/Gen visa company acquisition, what happens to visa

Post by johndepaspire » Fri Feb 17, 2017 3:05 pm

Hi members,

This is a different situation and I don't know how visa will sorted out for existing employees when there is company acquisition. There are 2 sets of employees some working on Tier 2 ICT visa and some working on Tier 2 general for the same employer, company A . Company B has taken over the company A. So how will the visa for employees working on ICT or General visa be transferred to the new company. I am getting different views and opinions on this. Also there is no concrete plan known to employees about how this will be resolved, as well.

Members and Administrators please share your knowledge about this. It will be very useful for me and also my colleagues. Appreciate your help.

Thanks in advance,
JD

Administrators and members can you please answer to this query? The client project contract based on which visa was issued will come to an end soon and there is uncertainty about the new acquisition.

Administrators, moderators please can you answer this query. It is very urgent, the team need to decide about new projects as their is not much clarity about how this will be handled after the takeover. Thanks, JD

Hello JD,

Have you read the Tier 2 Guidance for sponsors?

https://www.gov.uk/government/uploads/s ... 2-2017.pdf

Refer to Chapter 13 (Mergers, Takeovers and similar changes) on page 62.

Hi krisv,
Thank you very much. Appreciate your help. The document states that the visa need to be changed to new employer within 20 days of the official takeover. So the team can be moved to new employer with visa change within UK.
Thanks, JD
