Is Business Right on Tier1

Hi Guys
I just need to ask few questions about business is it fine


1- if you have contract with different companies for service providing and you send different people to go there and work, these workers are not on Payroll (they work themselves as self employed and they get paid directly from the company where they provide service) and my company get some fees to send that worker, i would say commission.

2- Like i heard people who are on tier 1 entrepreneur visa and running security companies they send security staff to different sites, is it allowed . But mine is not security company though

3- Temporary recruitment company, people who work on temporary basis like if permanent staff is off so we can send someone to cover there and gets commission. is it allowed.

on all above i am working as director and business consultant , i go to the clients meeting with them and get contract and start sending people which comes as NVQ Level 4 as well.

Thats really tricky question.. I have no clue about this but interested know from all seniors like CR001 and zimba etc about this..

If you have no employees on your PAYE payroll, you have not created jobs as required by your visa conditions.

Jobs have been created on payroll anyway one works as administrator, second one does marketing for the company and third one works as operation that whoever we are sending they are providing the services as per client requirements if anything wrong he reports to director . These three are on payroll
apart from these there more than 100 people registered with company who works as independently
is it allowed?

and as because i am director of the company and works as business consultant, make liaison with clients and make contract is it NVQ level 4?
i know business consultant comes as NVQ level . but what about in this situation.

There are no restriction on what you do within the law unless it is explicitly NOT allowed by immigration rules in the conditions of your stay.

Are YOU personally responsible for the work ?
NO

- Is the contract between YOU and the client rather than your company and the client ?

NO
- Does the client care about your immigration status ?

NO

- Can you send some other expert/consultant/employee from your business to do the job in your place or the contract demands YOU to be there ?
NO( but the person i am send are not on my Direct Payroll they are third party they work as self employed and some has their own Ltd company where they receive money by client)

- Does the contract control and mange your time, place of work, time off etc ?
NO(whenever they need anyone on temprarory basis we send someone from our list (again reminder not on my payroll person,its third party)

- Are your duties pretty much very similar to the duties of an employee of such company/client ?
NO not all of them but few of them but not my duties its the person's duties who i am sending to work to client premises

- Is your position simply a vacancy that normally an employee is expected to fill ?
Not really as client ask someone when they dont have anyone to work or someone calls sick or if they are very busy and need some extra staff or if someone is on holida

do these make sense please let me know i explained everything

It is at the discretion of HO to determine if your business is genuine or not.
The rule of thumb is to avoid what you have been explicitly told NOT to do in conditions of your stay.

what to do mean, is it means , this business not allowed
as far as genuinity is concern
i have few clients payment coming into my business account and i have payroll employees as well
what else they need to see

is there any written policy guide that this kind of business not allowed ?

Where in what zimba88 posted does it say 'business not allowed'?

I would strongly suggest you read the Tier 1 ENT guidance notes to understand what the requirements are and what documents HO want to see, particularly regarding proof of your investment of funds.

office insurance + Rent = 1200
