British Naturlization - Previous Tax Issues

Hello All,

One of my close friend needs help for regarding his naturlization application. His circumstances are following.

He came to UK in 2005. He got Tier 1 General visa in March 2010. As per his claims, he was director of the company at that time and he showed all his income as dividends in his initial Tier 1 General application. He paid the accountant fees and in return, the accountant promised him he will submit all his returns to Company house and HMRC for year 2009 - 2010 as this was the income he has submitted to Home Office for his initial tier 1 general application.

In early 2011, he got a job in another city and he moved there. As per his claims, he didn't bother whether the accountant had filed the tax returns to Company House and HMRC for 2009 - 2010 or not. In 2013, he has applied for Tier 1 General extension which was approved subsequently. All his income was made in form of salary and he has submitted proofs of his income such as payslip, employer letter etc.

Then he applied for ILR in 2015. The ILR was approved and all his income was made in form of salary from a different employer this time and he has submitted proofs such as Payslips, employment letter for it in his application.

Now this has been 2 years since he got ILR. He is going to send an application for naturlizaton. In 2015, He found out that the accountant didn't file any records to company house and HMRC so both of them (Company House + HMRC) have NO records of his self employment income for year 2009 - 2010 and the company was dissolved way back in 2011.

As per his claims, he understands he should have informed the HMRC and company house in due time regarding his self employment income and he should have paid the tax. Therefore he tried to pay the tax on dividends in 2015 but HMRC has told him that since the company was dissolved in 2011, So there is no way he can open the accounts for that company.

Could any one suggest should whether he should go for naturlization and take a risk. Or he should wait for 2020 to apply for naturlization because then it will be for 10 years since he got Tier 1 General though he is not willing to wait for 2020.

Because you have to go back 10 years it may be a good idea to engage an expert rather than risk the fee and potential good character implications.

Expert = first of all a good tax adviser
