Hi everyone! :D

me and my boyfriend have been together for just over a year and we got engaged around the christmas period (how poetic haha)....

the time has come for us to start putting plans in place. he is currently on a Tier 4 student visa which will expire in october. i made an appointment at a designated registry office for april to give our notice. i know that they require either 28 or 70 days due to HO interviews etc.... I'm just slightly confused about his visa.

i know that he can marry on a Tier 4, but ideally, we would like to apply for a spouse visa for him so that he can live, work and study here as the Tier 4 restricts you from working.

He is looking in to doing his masters degree here in september (one month before his visa expires)...has anyone had any experience with these two visas? I'm confused as to what we should do. should we apply for a spouse visa after we marry, or will that interfere with a renewed tier 4 if he is refused? I'm also wondering what would make him rejected from getting a spouse visa. There are so many things online but i just don't know where to look or what to believe!

Assuming you are settled or British, if husband successfully switched to FLR(M), then his Tier 4 leave would be superseded. Else, if he hasn't broken any conditions of leave, then they may not necessarily curtail his current leave.
