Hello

I am posting on behalf of a friend. This is not related to my case in any shape or form and assisting him with identifying the correct form for his extension.

My friend's asylum case was refused but was granted Limited Leave to Remain (LTR)in the UK under the Paragraphs 352ZC to 352ZF of the immigration rules in October 2014. The grant is discretionary leave.

The case workers refusal letter states that under the article 8 of the European conventions, it would breach his human rights if he was refused. So he was granted this DL.

His personal circumstances is that he is working after decision was granted (low income) and is married with a child. His partner and his child are British. He and his wife were interviewed prior to the decision.

His leave is valid until 06/04/17, we are really unclear of what route he actually is on.

On an asylum support letter, it states he is Family LTR.

Reading the rules, 352ZC paragraph in immigration rules is for "Requirements for limited leave to remain as an unaccompanied asylum seeking child".

He entered the UK in 2007 when he was 18, so I'm wondering if leave was considered on this basis? I have asked him to call the home office for clarification, as we all know, the home office can be very flakey.

Questions:

1) Does he fill out this form FLR(DL):

Which is a little confusing when you get to section 2 to explain why you are extending and states (not medical or family)

or
should he extend under family life?

If he does go down FLR(FP) does this reset his clock for ILR?

Does not make sense! Anyone will advice will be appreciated.

Have done some more research on this, previously it would have been easier to identify as the FLR (O) which is now no more.

Hope that someone can provide clarity further on this application to ensure if he does go via a solicitor it's the correct route.

Spoke to my friend, he will go via his solicitors as it's far too confusing to figure out ourselves. Can any admin/mod take a look at the post please and what thoughts come to mind?
