Hi Monz,
I am so sad to hear that your case also dismissed, I can't understand how someone gets it so easily while others have to try so hard, we also were very positive about our case as my elder child has been living in the UK for 8 years by the time of hearing, but it got refused, our judge was a lady too, hope not the same person. 😒

I did fee waiver for mine nd it's was accepted
Hi Alaga247, what are the requirements to apply for fee waiver, please can you list the basic things, my appeal was refused in March and I re-appeal to the upper tribunal. We were very positive about the appeal but couldn't win, so have no positive hopes about the upper tribunal decision as well, in case I want to prepare for a fresh application,
My husband has two bank accounts
We both don't work as we don't have no visa
But my husbands family helps us
We are renting a property, Pay the rent and bills, manage to do by sharing with friends,
If they look into the bank can see the rent and other direct debits paying off,
For 4 people to do a new application will have to find 4x1033 visa fees
4x1000 IHS
1200 for solicitor
Almost 10,000 pounds
Can you please advise me, so I can prepare by the time it gets refused in case
Thank you

Monz,

Your 8 year old wasn't born here but when did the child come to the UK? At what age?

Keep the faith in the end, once you get the approval, all of this suffering will be in the past!

It is psychological game, I have 2 kids, they have British passport, they are born in the UK. It is still difficult for me too. It is wasting of time and money . Home office need to establish a new rule (( falling in love with a British guy needs money, time, torturing and pain)) or(( the foreigners are not allowed to marry to a British citizens )) 😀😏..... It is a red light............ It is unfair, I would be very happy if they told me go back to your country at the beginning. I am very disappointed that they play cat and mouse with us. Dear monz,
The rule is for not only a child who is born here but also a child who entered to the UK and been living here. So your elder child is a qualified child. On my refusals from home office and tribunal both mention that my son asca qualified child. So your daughter is....
And I know more than 20 families who were in the same situation that you and I are in had their visa granted straight away from the Home office or through a first tier tribunal, even students whi done toic exam, overstayers and people who had done criminal like shop lifting and illegal jobs.

I don't know your whole story, but what I can say, I am a genuine person, been living peacefully, had never been to my country for last 8 years, have a British born child almost 7, never done any fraud but still my visa got rejected. If there is any personal messaging system I can show you my refusals and how unfair the decisions I received, what I feel it is the luck, some people get it easily, some not, we are in the bad luck side I guess 😕

It has been eight (8) months approximately since the application , I am still waiting.
I applied for EEA(FM) 2 times. They refused it, they said you circumvent the immigration rules, without having any evidence. They recommended me to apply for FLR(Fp),as the rule for EEA(FM) was changed in November 2016. I was living in Dublin for 2 years with my husband. I have 5 years Irish residence card.My husband lost his work because of back injury, we decided to go back to the UK, I was not happy because I heard a lot about torturing and difficulty in getting UK visa. I am living in the UK since 2015. We have clean criminal record...I don't have poor immigration history. .....they can do whatever they want..... I have seen people all their statements were not true, they were illiterate they got visa without any obstacles and they are siting at home even they do not like to go to college or do work......... It depends on our lucks.

The essence of patience is the willingness to endure suffering. Be patient.... I don't like to hear this any more. We are waiting for permission to live.... It is the same like waiting to die..... We escaped from facial discrimination, sex discrimination, inequality and torturing... In hope to find equality and to get human rights......i didn't realize I am the victim of facial discrimination....the effect of this waiting is irreversible and it wrecked my life..... I don't care if I got residence card or not.... Because I lost 5 years of my life in waiting.... I have changed from positive person full of ambition and dreams to negative, grumpy and hopeless person......homeoffice is responsible for all this happen to me.... Because they didn't send me back at the first place......

I have 5 years Irish resident card, I am living in the UK since January 2015. I applied to EEA(FM) two times, but they refused it.
My partner is British, we are married for about 6 years. We have 2 British kids 4 and 2.5 years old. We are living together.

I have applied for flr(fp) : 3/August /2018

Biometrics letter received : 11/9/ 2018

Biometrics done: 11/9/2018

I contacted local Mp, homeoffice replied that my case is complex in nature.
I am tired of this game😞😩 I lost 7 years of my precious time just because I married to a British guy. It is not fair... I lost my career..... 😩...... I am still waiting.... I don't know leave my kids and my husband alone or living like this..... This is really a psychological battle... 😭
