EEA PR to BC, what about non-EEA family members

Post by inczei » Tue Mar 07, 2017 2:57 pm

I am an EEA nationality with PR document, soon can apply for BC. I'll keep my European passport as well.
My wife and her 2 children are my non-EEA family members with RC (less than 5 years).
My question is:
What happening with their RC when I become a British Citizen? Can they still hold the RC or need to apply for another type of VISA? Or can they apply for BC with me even they live in the UK less than 5 years?

Your non-EEA family need to have PR before qualifying for BC, they can't apply with you.

However one word of warning...if you are granted British citizenship BEFORE your family have obtained PR you will no longer be able to sponsor their residency in the UK. :!:

They would have to leave and apply for a settlement visa under UK Immigration Rules on a fresh 5 year route to ILR. Better to wait to submit your BC application until your family are settled with PR.

Thank you for your quick reply and confirm my fear, I will do this, wait for them to settle in before applying my BC.

Hello,

just to confirm: once the non-EEA family members have acquired PR they no longer requre a sponsor so the EEA sponsor can become a BC without consequences for his/her non-EEA family members?

I have asked the same question in a different thread but the answer wasn't very clear: eea-route-applications/pr-of-unmarried- ... 26625.html
