Can a Non-EEA travel alone whilst PR is pending??

Post by RGS22 » Wed Mar 08, 2017 10:52 am

I am a Russian national, non-EEA, with a Spanish EEA spouse, we have both lived in London consistently for 5-6years. I applied for Permanent Residency in December as my visa had expired - I have a Certificate of Application letter and as I have now received my Russian passport back, I am hoping to travel (alone) next month to Switzerland and France and also travel to India for 3weeks:
How can I get an EU visa to travel to Switzerland/France without a UK Visa?
Will I be able to travel to India?
Will I be let back into London on my return if my PR is pending?

1. I am a non-EEA national
2. I have lived in the UK for 6 years
3. I am in full-time, self-employed work
4. I have been married for 5 years (in the UK)
5. My spouse is an EEA national and does not hold British citizenship
6. My EEA spouse has lived in the UK for 6 years
*7. We intend to file for divorce (but have not done so yet)
*8. We informed the Home Office of our ‘unofficial’ separation in my PR application
*9. We will both continue to live and work in the UK
10. My last UK Visa, expired 23.02.17
11. My last EU Tourist, C, Visa, expired 23.02.17
12. I have a current UK Permanent Residency application pending
13. I have a Certificate of Application letter from the Home Office
14. I have had my Russian Federation passport returned to me from the Home Office

I don't think a 'Family Permit' applies to my situation (my spouse will be in the UK) also I am also worried about claims that if I leave the UK the Home Office will cancel my PR application.

Any advice would be greatly appreciated!
