re-entering the UK after a voluntary departure.

Hello guys,

I wish to seek information in relation to situation about my Visa status now.
My student Visa was expired on 29th January 2017. Because I need to handle the unsolved problem with my part-time job company, and also want to pick my postgraduate diploma, I was applied the FLR(HRO) form on 26th January before my Visa expired. I am really sorry that I can’t remember the FLR(HRO) reference number, but I had the IHS number: IHSxxxxxxx.

After 3 weeks later, because My grandfather passed away, I withdrew the application to get my passport back, wanted to back China as soon as possible. But that time I still didn’t receive the Biometric Residence Permit letter. I submitted the withdrew form on 17th February 2017, the Record number: RODxxxxxxxx. The government website said ” You’ll usually get your documents back within 10 working days”.

However, after 10 working days and submitted documents not received form. I still didn’t get any letters or emails about returning my passport. So I phoned the HOME OFFICE and they let me contact voluntary department. The caseworker was very helpful and kindness, he let me signed the disclaimer voluntary departure form, the form number: 2xxxxxxxx1. So I have already bought the flight ticket, and will leave UK within 28 days after withdrew my Visa extension application.

Accordingly, I am really confused some questions, please provide me with the following details:
1. Am I belong to the over-stayer now, or my immigration status is still “withdraw”? Because I didn’t receive any notice after withdrew.
2. Do I have any reentry ban after this voluntary departure?
3. On the application UK’s visa form, there is a question “Have you ever voluntarily elected to depart the UK?” Should I answer “yes” or “no” ? Many people said this is about “Voluntary return home if you're in the UK illegally or have claimed asylum”.

2. Do I have any reentry ban after this voluntary departure? Probably one year under 320(7b), but which category of visa do you believe you now qualify for?
3. On the application UK’s visa form, there is a question “Have you ever voluntarily elected to depart the UK?” Should I answer “yes” or “no” ? Many people said this is about “Voluntary return home if you're in the UK illegally or have claimed asylum”. Yes.
