Hello everyone,
Thanks to the wonderful advice on these boards, I have been able to somewhat muddle through the application for an EEA permit for my husband, however I just have a few questions left, if some of you would be kind enough to respond.
Just a quick explanation of my situation. I am a British citizen living in France for the last 7 years and I recently married my Algerian husband, who has a student visa, in France. Next September, I will be starting a masters degree in the UK and would like my husband to accompany me for the year (possibly more). He intends to work in the UK as he has a masters degree in International Law and Human Rights and is currently working for several humanitarian associations in France. We would also like to celebrate our marriage in the UK as my family did not come to my wedding as i've been married in France before and this time I promised them that I would come to them.
Firstly, as the EEA national do I need to certify my British passport with the embassy in Paris? I can understand the need for nationals of other EU countries to certify their passports, but since my passport was issued by the Britain, is there really a need for this?
Secondly, here is the list of documents I plan to send with the application:
My husbands passport
Original Wedding certificate
Copy of my passport
Declaration that I will be traveling with my husband to the UK
Declaration of our history together with my wife
Declaration from my husband of our history together
Proof that my wife is exercising her treaty rights in France:
Original letter from my employer stating that I am employed there
My last three payslips
Tax returns for the past 7 years in France
Bill with both our names on it.
My bank statements
My French degree and language certificate
My decree nisi of divorce (I was married in France before)
My tenancy agreement
Our tickets and reservations throughout our relationship
Pictures of us and of our wedding
Are these enough in your opinion?
Thirdly, I am a little concerned that they will reject our application on the grounds of a 'marriage of convenience' as we only got married last week. We met in 2015 and started our relationship seriously in February 2016. We moved in together in October 2016. The problem is that we cannot actually prove our relationship from text messages etc before November 2016 as I changed my phone and provider and have lost the messages. Also, I don't use Facebook (I hate it!) and since we live in the same country we have never had the need to use Skype, etc. I also hate having my photo taken (even my mum has barely any photos of me as an adult), so we have only a few photos which could have been taken at any time. We are kicking ourselves now as when we fell in love we never thought we would need to document it for official purposes!
Does anyone have any advice on if I have enough evidence and what else I could do to help the application?
Any help would be greatly appreciated. Thank you very much.
