Tier 2 to ILR - Dependent's eligibility on absences

Post by pvenkatkrishna » Mon Mar 20, 2017 3:09 pm

Hi All,

Thanks to the admins for such a great platform.

Could someone please clear my confusion here!

Tier 4 - I (main applicant) and my wife (Dep) entered into the UK in Oct 2009.
PSW - May 2011 - May 2013 (both)
Tier 2 - 27/04/2013 - 27/04/2019 (Main and 2 Dep.)

However, My wife not in the country since Aug 2014 (wife went home for pregnancy. later wife and kid would come to the UK for a couple of months every year).

I am eligible for ILR in Apr 2018, as the main applicant (I am not absent from the country for more than 20days/year). Here my actual question is -

Do my wife (as she is with me for more than 2yrs in the UK) & son are eligible for ILR with me in Arp 2018 only? if not which visa she should drop next time?

Thanks in advance.
Regards,
pk.
