Tier 4 (Child) Student Visa

Post by Tennis247 » Mon Mar 20, 2017 10:57 pm

My husband currently holds a Tier 2 General Visa sponsored by his company and our daughter and I hold Tier 2 Partner/Child visas. His employment in the UK will be terminated this summer, but we would like our 13-year-old daughter to be able to finish another year at her independent school in the UK. I see that she can apply for a Tier 4 (Child) Student Visa. As U.S. citizen, I am able to visit the UK for 6 months without a visa. We will have our main residence in the U.S. If her student visa is approved, can I live with her in the UK while she is finishing school as long as I leave the UK within 6 months of entry after our Tier 2 Visa and then re-enter again a few days or a week later and stay for another 6 months?

Afraid not, its not permitted to reside on a visit visa.

You need to read this https://www.gov.uk/parent-of-a-child-at-school-visa as it tells you how you can apply for a visa as a parent of a Tier 4 (child)

I think you need to read it too! That type of visa is only for the parent of Tier 4 Child visa holder who is under 12. OP's child is 13.

Your daughter would have to be at boarding school or with a guardian family. You are not able to remain in order to care for her as you do not have that right as she is over 12 years old.

As a parent, I think they should increase the 12 year old limit up higher, when children may be less traumatised at boarding schools.
