PR application - student & worker with no WRS

Post by Inactive8 » Tue Mar 21, 2017 6:51 pm

Hi, I had failed naturalisation as I found out my residence card was in fact registration certificate.

So now applying for PR - first arrived in September 2007 I was in full-time education and had UK EHIC card (from 01/2008 I think as I am on the 2nd one now) not sure if this applies towards PR as apparently, I needed comprehensive sickness insurance, EHIC not from UK (online PR form states).

Secondly, I did not have WRS from 02/2008 when started casual work in an agency (later another one) so I was told this period does not count towards PR requirement.
From 30/04/2011 WRS ceased to exist for EU8 - I gather that I can count this period from 01/05/2011 or 01/04/2011 (toward PR) as I was in full-time education & part-time employment at the time / full-time work xx/07/2011?

I spoke to HO over the phone and was told to include all employment and that it doesn't matter as from 05/2011 I do qualify.
WRS apparently was employer responsibility (according to SOS Polonia), I was unaware and never received one.

I am still concerned no WRS on record will affect good character requirements later for citizenship application

Back to part of form / online PR application

Did you work during the accession period without holding one of the documents listed earlier? Yes
Why was this? Worked without permission - Worked without documents
If you worked without permission at any time during the accession period (and were not exempt), give details including:
name of employer
date unauthorised work started
date unauthorised work ended

Should I include employment from 02/2008 even without WRS - I did in naturalisation form (employment part) or should I leave it out and make it simple as of 01/05/2011 onwards? Anyone with similar successful PR application?

Can anyone comment on WRS situation from their experience
I gather that from 01/04/2011 (or May to play it safe) anyone can state they wish to apply from this date?
Were students not required to apply for WRS?
According to Wikipedia:

Abolition
On 30 April 2011 the worker registration scheme was abolished. By the time the A8 countries had been in the EU for over seven years (1 May 2004 to 20 April 2011) and the maximum extent of the temporary measures, which were allowed by the Treaty of Accession to the EU (from 2003), had been reached and therefore since then their nationals enjoy the same rights as those of the older member states. While registration was no longer possible from 1 May 2011, because the scheme only required people to register if they were working for longer than one month, this meant that anyone starting work after 1 April 2011 no longer required to register.

Workers that were exempt from registering on the scheme included:

those who were self-employed
those who were students
those who were working legally in the UK on the 30th of April 2004 and continued in their employment
those who were in continuous employment for a period of at least 12 months falling partly or wholly on or after 30 April 2004
those who had left to enter on the SAWS scheme before 1 May 2004 and had started working in the UK under the SAWS scheme on or after 1 May 2004
those who were providing services in the UK on behalf of an employer who is not established in the UK.
