Hello all

I am on a Tier 1 Entrepreneur £200K visa and I'm about to hire the second employee. There is someone interested in the position for at least one year, who has British citizenship, and already works in a full time job (38 hours per week) for a big company. Due to the nature of our business and the new position, this employee can work even over weekends and from home, while they're keeping their first full time job.

Now my question, is when it comes to applying for an extension, does this employment count toward the points needed for satisfying the job creation requirement?

Yes, rules do not care if someone has a 2nd job. As long as they are employed as per law and the taxes were paid correctly.

beware that working 10 hrs a days 7 days a week (38+30), + commute times is not really sustainable for a high value employee. S/he might not last long and then you don't have continuity in the job (not great for business nor t1e)

And If s/he does not have some special skill then why do you need to hire him/her specifically?

When HO starts clamping down on all those jobs that mysteriously were needed for only one year and then disappeared do you want to be under suspicion?

Not to mention those jobs that 'someone was paid to get point and some of the money flowed back'
