Fresh aplication 200K inside the UK

Dear Gurus,

One of my friends has a valid Tier 1-Ent-50k visa, he lives in the UK, he has a good company and he did not know that he has to employee 2 full time jobs, his visa will expire in Many 2017,
Can he submit a fresh application inside the UK, he wants to apply for T1- 200k (new application) before his last visa expires.
His solicitor told him that he can do that under immigration rule:

245DD. Requirements for leave to remain

(e) The applicant who is applying for leave to remain must have, or have last been granted, entry clearance, leave to enter or remain:
(iii) as a Tier 1 (Entrepreneur) Migrant,

Can he do that?
