Tier2 general to ILR-35k

Hi
My husband is on tier 2 general and due to apply for ilr in Nov 2017. In order to reach the 35k threahold the emoloyer had agreed to increase his hours from 37.5 to 42.5 and they sre happy to inform the ukba about the change.I read that the hours in Cos has to be nothing more than 40.is that right? If so, increasing the contracted hours is not an option ?

268.If you are paid hourly, you can only claim for earnings up to a maximum of 48 hours a
week, even if you work for longer than this.
For example, an applicant who works 60 hours a week for £12 per hour will be
considered to have a salary of £29,952 (12x48x52) and not £37,440 (12x60x52), and
will therefore not meet the minimum earnings threshold.

But make sure the salary change happens at least a couple of months before he applies, so it reflects in the latest salary slip at the time of application.
