Tier 2 general employer sponsored dependent visa

Post by sam08016 » Wed Apr 05, 2017 10:36 am

Hi,

I have recently completed my Ph.D. from Australia and received a job offer from an A rated sponsor in U.K. Currently I am applying for a tier 2 general employer sponsored visa for UK for me (as primary applicant) and my wife (as dependent).

My wife applied for an Australian student dependent visa last year, which was refused as she was not able to meet the "genuine temporary entrant" condition (one of the conditions for Australian student visa). This condition requires the applicant to demonstrate that she intends to enter Australia temporarily and will leave Australia at the end of her visa period. Although, it does not bound you to leave Australia and you still can apply for further stay with same or another visa.

During the interview for the Australian visa she told the interviewer that she intends to leave her current job (in Pakistan) and join me in Australia. She also said that since she will have full time work rights in Australia (she was applying for postgraduate student dependent visa that allows full time work) she may look for a job in Australia.

The assessor raised a concern that if she quits her job, then there are less chances that she will return to Pakistan at the end of her visa period. Therefore, her visa application was refused.

She is still doing the same job she was doing before and intends to leave it as soon as we get the visa for UK.

My questions are, how shall we address the question in VAF10 form that asks if she has been refused a visa for any country including UK? Will a previous visa refusal affect the UK visa process? Also, how shall she handle the questions if she has to attend an interview for the UK visa?

Your help is much appreciated.
