Uk overstayers

Hi everyone,
I'd be grateful if someone could clarify for me this situation.
I have been in a relationship with my partner for one year and half, he's from Kosovo and I'm Italian.
He's got in Uk with a medical Visa then he renewed it twice.
His last visa expired 2013.
We have been living together since April 2016, then we applied in the register office for wedding and we waited for the 70 days Investigation period.
Then they asked to attend interview but our lawyer advised us to don't go because we didn't have a Tenancy agreement and Deposit scheme with the Landlord.
They sent another letter to go to the interview today but again we didn't attend even if they said that our relationship is genuine because in the end we thought better leaving and drop everything.
He booked a flight on Saturday morning, could you tell if in your own experience/knowledge they're going to stop or detain him?
Please, I need your opinion.

I would of chanced the interview

I know of illelegal Albanians who have attended the marriage interviews and then been granted permission to marry then got 5 year visas for being with someone from the EU

What's your solicitor suggested? We were told it's harder to fight from outside the UK then from inside.

Having failed to attend the interviews the Case Worker is likely to take the view that the relationship isn't genuine when your partner submits an application from outside of the UK.

His last Visa Expired in 2013 so he has been living in the UK as an overstayers since and regardless of the wedding the HO will deport him... I don't understand why the Registrar Office accepted the marriage in the first place if the guy was illegally in the UK...
