Can a new born baby in Pakistan gets British passport?

Post by Abrahim » Fri Apr 07, 2017 3:04 am

Dear All,
Thanks for reading the post, I have already tried to find a similar case in this forum of British Citizenship but couldn't find one. I am in England on ILR, got married in Pakistan the second time, divorce is in process with my ex-wife in England. My second wife is still in Pakistan until the divorce is finalized.
My question is I have a baby boy born at the end of January 2017, with my second wife in Pakistan. How can I apply for my son's British passport in Pakistan.(bare in mind, I am going to apply my second wife's spouse visa once my divorce takes place in England).
Shall I wait for divorce to take place and then apply for my son's British passport in Pakistan? What document would I need? Do I have to do some DNA test ? Please help. many thanks.

If your son was born in the UK, then he is automatically British. If he was born in Pakistan, then he isn't British and is ineligible for a British passport.

Children born abroad have the same status as that of the less-privileged parent. So in this case, the child's UK immigration status will be the same as your second wife's and he will be eligible to apply for ILR with your wife and be registered as a British citizen after that.

Also be aware that as you married your second wife before your divorce with your first wife was finalised, that may create issues during her application (and hence that of the child as well). I will leave it to others to advise you on that particular aspect.

thanks for your reply, just to be clear that, I have separated from my first wife since 2013, and divorce is finally in process. Therefore I think that it shouldn't be a problem for applying for her visa?
