Dependent visa

Post by LondonGuy121 » Sun Apr 09, 2017 11:25 pm

Hi folks,

I got my Tier 2 visa (General) in May 2012, I renewed it again in May 2015 until May 2018. I am now applying for my ILR in May 2017 since I am now eligible for it.

I got married in 2015 and my wife joined me on a dependent visa until 2018. Since she hasn't completed 5 years in the UK, she is not eligible to apply for the ILR with me.

Hence I wanted to know if she can stay on the same PBS dependent visa until 2018 and then extend it again?

Or do she has to re-apply with the FLR category after my ILR is granted?

Your responses are much appreciated.

FLR required?

Post by LondonGuy121 » Wed May 31, 2017 1:48 pm

Hi folks,

I was on a Tier 2 General visa which was valid until May 2018. I got married in 2016 and my wife joined me in the UK as a PBS dependent in January 2016 with her visa expiring in May 2018 as well.

I was eligible for ILR in May 2017 for which I applied and my application was successful/approved today. My wife couldn't apply with me since she has not yet completed 5 years in the UK.

I had the following queries.

1. Does she need to apply immediately to switch to FLR or can is her PBS dependent visa still valid until May 2018? Or is there any other category she needs to apply through?

2. Once she applies for the FLR, does the clock on her time in the UK gets reset and she has to again complete 5 years on FLR?

3. Are there any suggestions on when should I time her FLR? Now or later in May 2018? Given I will be eligible to apply for British citizenship after May 2018?

Thanks in advance for your responses.

Thanks Vinny.

So when she extends in may 2018, will it be under FLR (which will reset the clock of 5 years) or can she keep on extending as PBS dependent?

I wanted suggestions fro you guys if I should be extending her visa now under FLR or wait until next year?

Yes.
If you were granted ILR as a PBS migrant and not under Long residence, then,
