Arriving in Ireland without a Visa accompany an eu national

I am from Ghana and presently live in Ghana, i am married to a British citizen, we have a daughter and another child is on the way. They live in England and i live in Ghana but my wife doesn't want to move to Ghana and she has insisted that she can't be by herself with two children. I have a very adverse UK immigration history due to the work of bad agents in the past which was years ago in 2004/2005. To summarize it quickly, I applied for UK visas back then with my name but under different date of births and details but name was the same,all applications were refused however i got to enter the UK through deception and i lived there till 2011 when i returned to Ghana out of my own free will and i never had issues with UK border force. I applied for a visitors visa in 2013 and my application was refused and banned under paragraph 320b due to not remembering details of my past applications with the UK embassy. My wife is a student in the UK and i support here financially from Ghana so we cant apply for the UK spousal visa at this point in time as she doesn't meet the financial threshold. we want to move to Ireland using the Surinder Singh route but i have heard of severe delays from the Irish embassy in processing spouse accompany/join eu spouse visa but presently i have a valid Schengen visa, my questionas are hereby listed below

1.can i get a visa on arrival at Irish ports if i travel from the schengen area with my spouse and children(all BC citizens) and she is exercising her treaty rights
2. or do you advise me to use the malta route as we are planning to use the self sufficient route.
3. also does the UK spousal application take into account the income of the partner that is not in the uk when making a spousal application

Basically the answers to your questions are:

1. It depends, you will be processed when you arrive. Also the Irish immigration agency has a close relationship with the UK agency. So if you have been banned they will find out pretty quickly and you will be refused entry, as you have a bad UK immigration history they will assume your trying to travel back to the UK. Also if you are flying with an EU airline they will not let you on board unless you have the required visa to enter that country or else they will get a big fine if you are refused.
2. No idea about this route
3. The UK Spouse application is based on the income from the person already in the UK. This must be £18,600. More if your children are not British citizens. But as you have stated you have been banned - however you have not stated for how long. This will impact negatively for all future visa applications.

Hi there, I feel for you as you are in a difficult situation like most of us, and would definitely not recommend the Irish route unless you get a stamp at port which I doubt plus heard they no longer do that, if your wife does genuinely move to Ireland and use Eu trashy rights it could be a long process 1 year or so, been waiting 8 months no reply. May God bless all the families that are apart and bring them together soon.Even with a clean record ukba a quick to refuse so UK route will have to go through appeal a long and expensive process.

1, no, u wont be able to ARRIVE to Ireland, cause u cant board any flights or ferry without Irish visa or article 10 card, u can apply for Irish eutr visa but it takes like 1.5years and a good chance u would be refused, also UK is out of the EU by March 2019 when EUTR wont apply anymore
2. u can do that if u can get a schengen visa, which is probably easier to get, based on self sufficiency u can get an article 10 card in about 6 months, but for that ur wife has to quit studying in UK and move to Malta, , so u can travel back to UK till March 2019, but than what...u wont be legal there cause Surinder Singh is only accepted based on work or self employment in Malta, so u can go back this way to UK but i dont see how u could legalize ur stay

ohh i did not see u have schengen visa already, than article 10 card is not too hard to get in Malta for u, i mean assuming ur wife is willing to move to Malta with the kids, so overall it wont be easy, but from a legal point of view.
Dont see what is ur ultimate plan but i guess go back to UK. I think the fully legal way for u is to move to Ireland eventually based on eutr and after 5 years get the citizenship (hopefully u did not do something really bad in UK, cause u have to be a good character to be accepted). Of course ur wife has to live with u in Ireland for those years, is she willing to?

This is not clear yet as brexit talks are ongoing but after UK left the EU Irish will be the only non-UK citizen who can work in UK without work permit, as an Irish citizen is a permanent resident automatically in the UK.
OR if ur wife will start to work and earn more than 19k a year u might get spouse visa, dont know about ur chance to be refused because of immigration history.

I think i will take my chances and go the Ireland route. I did not do anything bad in the UK,I have no criminal records whatsoever. I was banned for ten years in 2010 due to issues with immigration history basically deception and i cant even remember the details for the application. I was young and desperate then and badly advised by stupid agents but now i make sure i do everything by the book. I have valid visas for schengen,Canadian,USA, and a host of other countries.I think that should help with the application. The truth is i am not desperate for British or Irish passports, i just want to be able to travel and visit my family whenever i want in England which i can't at the moment. I will engage the services of a top UK immigration Solicitor. thanks once again for taking out time to reply.

I have a slightly similar situation. Though Im in the UK with my British spouse. I want to move to Ireland with my spouse on her treaty rights. I only have my Nigerian passport with no residence permit. I'm wondering how to get to Ireland from the UK.

I have been living in Ghana since 2011, I applied the normal way as a tourist and they saw i have enough ties to Ghana so the visa was issued. about getting to Ireland from the UK,i have no clue as i live in Ghana, you can as the more experienced members here. goodluck
