ILR based on marriage. What happens after divorce?

Post by LuluMB » Mon Apr 17, 2017 7:57 pm

Hi. Can you please advise. I received my marriage visa and then ILR with no resource to public funds about 5 years ago. I had chance to apply for citizenship but didn't. Now after 7yrs marriage I decided to divorce due to husbands inappropriate behaviour. Do you know what are my rights for the property, I didn't financially contribute to it and the house was bought before we got married . We have a 4 year old daughter British citizen . Do the court ask to leave the country in situations like mine. I'm Russian citizen, have job in the uk and pay tax. I have settled in and would like to continue daughters education here in the uk. Also if I will find out that I can't afford to provide fir both my daughter and me on my salary and child maintenance from ex husband, will i be able to apply for child benefit?
Your advice would be highly appreciated.
Thanks
Lulu

If you have ILR then you are entitled to claim public funds as you will no longer be under immigration control, and as you are settled you have the right to remain in the UK even if you are no longer with your husband.

I suggest you contact the Citizens Advice Bureau (CAB) for help regarding your divorce and what rights you have. This isn't the right forum for family law advice.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
