Tier 2 sponsorship license refused (Should we reapply)

Hi everyone

My company have applied for sponsorship licence in the last week of December i had tier 4 visa at that time which expired on 30th Jan 2017 so i applied for FLR before my visa expiry and by the end of Feb our sponsorship license application was rejected which we got to know by around 15th of march and now i need experts advice that would it be feasible to apply again for sponsorship license the difference between last time and now is that last time when we applied i had a tier 4 visa but now i am waiting for FLR decision so in short don't have any proper visa i guess.

what i think is now i am not exempt for RLMT test so no unrestricted COS for me and if i assume our sponsorship license application would be accepted we then have to apply for restricted COS and i don't know what are the chances of getting that and on top of that i have time to stay in UK till i get a decision on FLR which would be soon i guess.

Why was the licence refused?
There is a small matter of not being able to apply again for six months....

Hi

We applied the license by ourself so we missed to provide this information

what job or jobs do you intend to assign a certificate of sponsorship (CoS) for? This information must include the:
o job title and Standard Occupational Classification (SOC) code
o duties of each job
o where each job sits on the hierarchy chart referred to above
o salary you would guarantee for each job if it were vacant today
o skill, experience and qualifications required for each job

If you have already identified a person, including if they are a migrant already working for you, and intend to assign a CoS to them you should
provide the following details of the person:
 full name
 date of birth
 nationality
 current immigration status
 current job title and duties
 3 x monthly payslips if applicable

although we wrote some of the answer from above section in online application where it asked reason for applying.

Well so as you said we cannot apply again for six months.

Hi Guyz

i am of a view that once your tier 2 sponsorship application is being refused you can apply after 6 months
The reason of refusal was that we didn't provide the mandatory documents required and the VISA fee was refunded.

I have met a lawyer who said that our application was not even qualified to begin so thats why rejected he means that we can apply again for the sponsorship license of the same company and this 6 months period doesn't apply to that. I just wanted a second opinion on that .

secondly i read on govt website that you can transfer tier 5 temporary work visa to tier 2 but the same lawyer said you cannot change from tier 5 to tier 2.

and the last question i have applied for FLR on the basis that i am waiting for my employer sponsorship certificate i have given the bio metric in last week of February so i am not sure if i have enough time to reapply for sponsorship application and get a response before FLR decision . I am of a view that once you get a decision on FLR you cannot anything else and have to go back to your home country and apply from there again because you don't get any right of appeal but again the solicitor i met was of a different view and said it is possible to somehow stay here legally after FLR decision until we get sponsorship license and then can apply for tier 2 work visa.

I am so confused with all of this above i would be thankful if i get any device or second opinion on the matter above.
