EEA PR Section 16 about Benefit received and passport expiry

Post by Andy Canova » Wed Apr 19, 2017 1:34 am

Hi Everyone. I Believe this Forum is the best and thanks to all who helped other members.
I'm Non EEA National with Residence Card Married to EEA National. My wife has been in the UK since 2004, she has been working since until now but from January 2012, she become qualified job-seeker until October 2012 claiming income based JSA also from February 2012 until June 2013, from October 2012 until March 2017 she has been qualified as a worker. most of the time as qualified person from 2013 and 2015 she was claiming housing benefit, council tax benefit, child tax and working tax credit as my wife was on low income with par-time job and full-time job and my self too i was doing part time job pretty much same period. after from 2016 until now we have both full time jobs

Myself and my wife decided to apply together as we have been married from March 2012 and I'm happy to say that we will continue forever and this new immigration changes is really putting us on stress as we can't bear being apart from each other. Also we have our daughter who is born and study in the UK and we will get her hopefully her BC after we acquire our PR.

Here is the questions if kindly answer me quickly as we are sending everything in couple of days:

- for the first qualifying period, which better to put self employed or job-seeker from period March to October 2012 ?

- section 16 about declaring benefit, they are asking to declare everything but we feel it would be too much to declare as HO might refuse our applications for public fund burden grounds (i just think that way but also we know that my wife has been qualified in the UK since 2004 hence she has the right for any benefit) to add to this my wife has also claimed benefit before from 2008 to 2011 as she was working with low income again she was qualified person. now the question is: do we have to really declare the benefit otherwise if they find out they might reject the applications or just go ahead and declare it all, if so Please Please can anyone say if they know someone with same situation where application with benefit got accepted for PR application.

- my Non EAA passport expires on 07.11.2017 (i couldn't renew it as it has to be only 3 month left to expiry date according to my lovely embassy) and upon applying for the PR, we are making sure to hopefully apply in couple of days because we know when it will be received by HO it has to be valid for at least 6 month so deadline in 07.052017. does anyone know when the start date of passport validity before expiry date starts, is it when from HO receive the application i mean when they sign for it from the post man or when the application payment is gone through or when the certificate of application is received ?

- My wife has renewed her passport this year. do we have to send her last new passport or we include the previous one too ?

Guys your help on this is really needed and all answers will be greatly appreciated.

Many thanks

[quote="Andy Canova"]

Just small clarification: from January 2012, my wife had knee injury so she couldn't work and become unemployed. she become job-seeker (qualified) and she claimed income based JSA until October 2012 as from October 2012 she found a job and become a worker with PAYE. she continued with 3 different jobs until now but first job from October 2012 until May 2015 she was par-time with low income hence why the benefit (i was also on low income doing part-time job, this to explain the family situation to justify the benefit under her name).

Also for the period of February 2012 to June 2013 and in addition of being job-seeker she started a small business as mobile hairdresser and being self-employed. the self-employment closure date is June 2013 and at the time until October 2012 she stopped doing hairdressing (last customer receipt was in October 2012) as business wasn't going very well.

this above explanation is for the question: for the first qualifying period, which better to put self employed or job-seeker from period March to October 2012 ?

Please note we are using the period from March 2012 to march 2017 as qualifying period because we got married and started living together at same address (until now) since march 2012 and that period should prove continuous 5 years required for the PR.

i do apologize if my wordings wasn't clear at the first post.

Kind regards
