URGENT VISA ADVICE PLS!!!

URGENT VISA ADVICE PLS!!!

Hi,
I recently came back to the UK after 24 yrs abroad and am looking for work.

I was born in the UK and hold a UK passport, For the past 4 months i have been on JSA & HB.

I have 2 children both UK passport holders and my wife is Jordanian. Can i apply for a visit visa for my wife as i'm currently unemployed or would i need to be in work as i need her to bring my children over in the summer in time for school and my plan is for my wife to stay for 6 months for the kids to settle in and by then if i'm still unemployed would my wife still ave to leave or could her stay be extended?

Thanks and would appreciate any advice.

It's probably unlikely that her visit visa would be granted. She would have to show pretty strong ties to wherever she is currently living. Of course you can apply, but UKVI might take the opinion that she would overstay or apply for FLR(FP) once in the UK to frustrate the immigration rules. This is nothing to do with your wife - it has to do with many other people 'abusing' (using?) this route and the UKVI take a view that it isn't the 'right' way to reunite families.

If she (somehow) manage to get a visit visa, she would not be allowed to extend her stay.

It might prove more successful for her to come for a week or two? People who have jobs etc... generally cannot take extended holidays of 6 months, so she might look like the visitor that she is meant to be!

I just wanted to add that we have been married for 16 years if that helps and she does have strong ties in her home country as her father/brother/sister are living there.

Also does it make a difference in the application , my wife and I had visited the UK for a holiday back in 2004 for 3 weeks.
My wife has no intention to overstay because my long term goal is to obtain her citizenship and i do not want anything to affect that.

Strong ties of family living there probably aren't considered. All immigrants have family abroad! Length of marriage actually might mean she is more likely to stay in the UK...

Strong ties generally are things like: events where the visitor is required back home, financial obligations back home, owning property, and probably the biggest: a job where the employer states the employee is required/ expected back.

That's great that she has no intention of breaking immigration rules, but the trouble is that a lot of people in the past HAVE, which jut makes things harder for immigrants obeying the rules (so-called 'legitimate' migrants).

All you can do is apply and see... just have lots of documentation to prove her ties to her country and try to convince the ECO that she will abide by the rules and that you are aware of all the rules.

I personally would not come for a 6 month visit, maybe a month might look more like a visit, instead of living in the UK (which is not allowed on a visitor visa).

You will also have to convince the ECO that you have enough money for her trip, and if you are claiming JSA, 6 months might be a bit of a stretch!

I'm sorry with all the questions, its just that i'm very worried.

My father is a homeowner here but not working, would he be able to apply for my wife's visit visa as he is better off financially.

My opinion is that it would be a gamble either way. You can apply - if refused it will not harm any future settlement visas.

My advice is to apply for a short visit (and maybe a second short visit later in the year). Set the precedent of coming and going as stated in an application on a series of short visits is more likely to be approved than a 6 month stay (which is actually to live in the UK which is not allowed on a visit visa).

I do not think a 6 month visit would be approved (but would be happy to be proven wrong!!).

so please correct me if i'm wrong, I will need to apply for a standard visitor visa which allows a person to stay for up to 6 months and my wife will inform her intention is to stay a few weeks as also i do not want my children to travel alone to the UK.

Then after her initial 3 week visit she will leave the UK and then apply again after a few months.. is that correct?

Seems the most sensible plan to me.

The visitor visa (if approved) would be valid for 6 months, but your wife should return when her application states. They check not if people subsequently apply for another visitor visa that they left when they said they would.

In regards to my above situation, can someone please advise me if it would be better or possible that my father apply for my wife's visa as he is a self employed and is a home owner.
