I was visiting my brother and his family in republic of Ireland where I was introduced to my now spouse. We did religious marriage as per our faith after knowing each other for couple of months. That was in May 2016. After a month we served a notice of marriage togather. I extended my visitor s visa for another 90 days due to unexpected and new health concern.
We were refused further extension in ireland. Time was ticking, before the visa could end , I exit to uk to visit my Aunt who was recently diagnosed with Cancer. I made few enquiries with the immigration and learnt about CTA. But at the same time, i was encourged to believe that if i presented myself at Dublin Airport i might be allowed to enter as decision is upon discretion of the immigration officer. I went to Dublin with all the documentation and got visa for another 90 days.
My spouse is claimant of asylum in ireland since 2014 while I am canadian national. In 2015, I had moved back from Canada to UAE to live with my parents as I had collapsed and was hospitalised due to brittle and uncontrolled diabetes .
Any how , I was refused to enter ireland when I exit uk again in Dec under immigration act 2004. They sent me back to uk where they refused me to enter at bhx airport. My parents arranged ticket for me to return to UAE due to unexpected refusals at both the ports.
I had lived for a total of 9 months in ireland hoping that we will be granted permission to get married in ireland and to get irish certificate of marriage to be able to apply for spousal Sponsorship in Canada.
Last week , the head office Roscommon refused the permission to marry based on my domicile. They did acknowledge my domicile for year of divorce in Canada. After I had returned to UAE last dec , my domicile has become questionable.
I was born and raised in the UAE living as an expatriate along with my family. My ex spouse and I had applied for Canadian immigration under skilled worker category as permanent residents from UAE. I , than moved to Canada where I had lived fr six years and more. I shall be going back to Canada once my paper work for marriage is completed in ireland.
I am not sure what my options are? Will I be able to visit my brother and my spouse in ireland ? How do we sort marriage permission in ireland after its being refused ?
I am 38 year old woman , divorced previously , no kids from previous marriage , an insulin dependant diabetic , looking to have a family with my now spouse. That's all I am looking for.
