Claiming benefits while waiting for ILR decision

Post by angeloick » Sun Apr 23, 2017 7:56 am

Hi All

I have applied for ILR in January and still waiting for the decision (biomectric done )
I have received two weeks notice at work and I would like to know
could I still claim JSA ,HB while am waiting for my ILR decision?
could I still apply for jobs without any proof of identification (All my documents are with the home office and I had just an email as proof that they are dealing with my application )

thanks in advance for your help

You are still under Immigration control under ILR has been granted. At present you have no recourse to Public funds but you may be entitled to claim Contribution based JSA if you have paid sufficient Class 1 National Insurance contributions in the 2 tax years before the current benefit year.

Do you have a spouse who is entitled to claim benefits?

How long have you been employed in the company? Was the correct procedure taken by your employer when giving you notice of termination ?

Thank you Casa
My wife is british an could claim benefit I hope
I have worked and contributed enough tax in the 2 years tax
The position was a temps to permanent position but the company has advertised to take an apprentice

I was under the impression that the job was mine (after a successful 4 weeks review and Working for two weeks unsupervised )
A bit disappointed to be honest to the way the termination was announced (my boss wants me to work till I find another job) I am not that happy really to work my termination notice because I think I was just hired under false promise

Note the requirement is for sufficient NI Class 1 contributions in the relevant 2 year qualifying period, not Tax.

Your wife can claim HB as a single person (+ children if applicable) but she must declare joint income in the application.
