NI TAX Exemption

Post by chandanprakashkudlu » Mon Apr 24, 2017 2:44 pm

Hello Team,
This is regarding NI Tax exception one will be eligible for initial 52 weeks in TIER2 ICT Visa.

Query :
I came to UK on Tier2 ICT visa during OCT 2015.

Because of Project budget issues, I have had a break in my UK employment as below,

OCT 7th 2015 Tier2 ICT work Start date in UK
SEP 23rd 2016 went to Home country to work from Offshore.
APRIL 10th 2017 back to UK on same VISA and COS.

As you see starting from SEP 2016 till April 2017 I was in my Home country with No Salary and Benefits in UK, But now that I am back in UK on April 2017 after 6 months of GAP, will I be eligible for any NI Tax exceptions ?
Also, will there be any changes in my TAX code(1160L) due to break in 6months of UK employment ?

Please share your thoughts.

Thanks and regards
Chandan Prakash

Did you come back on the same visa? I'm assuming YES.

(1) Personally, I feel your employer should have informed UKVI about your relocation to home country since there was a break in UK employment. However, its a separate topic of discussion.

(2) Since they did not inform and you came back on the same visa, I don't think you will get any NI exemption.

(3) Tax code will be based on the current tax year and has no relevance on the gap period.
