tourist visa schengen applied under eu directive

greetings to all senior advisors, my story in short
applied tourist visa for 15 days to france under directive all papers authenticated registered correctly submitted. visa apllication more than 60 days waiting. not a single notice and cooperation from French embassy. Phone calls and emails unanswered from French embassy. submit complaint by solvit more than 5 weeks ago no results. please advise from seniors.
my wifes lives in india we like to travel together to france for vacation i am a citizen of NL.

visa is refused after 80 days and the reason given nr.8 of the refusal form. appeal can be written only in French so i think its end of the story and no help from this forum also.

yes it is and they couldnt find anything after 3 months so just cross nr.8 and remarks documents presented could not be authentified by dutch authorities.
all of our documents was legalized and authenticated even our marriage was registered by dutch govt.
so its make clear they dont let you exercise the treaty rights.

all standard things like our passport,birth cert,marriage cert,return air ticket,hotel booking,travel Insurance and proof of that we travel together.

I guess you applied for the wrong visa.
Normally you should mark other in field 21 of the schengen application form and write family member eu.

In such a case the refusal is illegal.
Nr. 8 is not a valid reason to deny a visa for the family memer of a eu citizen.
If you want you can file a complaint to the eu commission. The problem is it can take up to 6 month.

thanks for your information. I already submit a complaint by eu commision they reply me if they handle it or not they will let me know.

hi mgb please advice after refusal i made a new complaint by solvit and earlier before refusal by eu commission. can i apply again the same visa by french embassy or better to wait of outcome solvit and eu commision. it takes one month to get a appointment by french embassy. kindly your advice

You could plan to fly via a other schengen country and apply there.

Why you made new complaint with solvit? You couldn't update old complaint?

please dont expect anything from solvit. they send me email stating

The French embassy was asked to send a new request the NL authority to have the confirmation that the document is authentic. As soon as they get it, the visa will be issued.’’

this is there findings and they close the file i ask them not to close because i didnt had any msg from embassy.

two days later french embassy call her to pick up the passport with refusal.
they are just pissing on directives and dont care about anything.

No progress in my case yet, its more than 115 days since i have applied, contacted solvit 50 days ago and they say they are working on it actually they are cooperative over the phone, submitted complaint to eu com as well lets see what they do. I hope solvit will be helpful.

I hope it for you. If there is no solution just bring them to the european court.
