Query regarding Tier 2 Extension

Hello gurus,

I got my Tier 2 Visa in Nov 2013. Then I switched to another (current) employer in Aug 2014. Now I'm up for renewal this July (2017).

My employer has issued me the new COS. In the COS, there is no mention about "Is the job on the current shortage occupation list?:" Instead I can see "Have you met the resident labour market test?:" But My previous application was made under Shortage Occupation List.

SOC Code: 2136
Job title : Developer / Technical Lead

I'm not sure, if it is ok to submit my application under "Shortage Occupation List" or ask my employer to update the COS.

Pls advise.

if the company and soc are the same, u dont need to satisfy the rlmt.

Thanks for your reply iworker. Does that mean I can still apply under Shortage Occupation List, even though it is not mentioned in the COS?

I tried to fill in the application online and there is question "Is your job with XYZ Company on the shortage occupation list?." Not sure if I should yes or no because it is not mentioned in the COS.

U need to look at the list, and see if u perform one of the jobs listed against the 2136 code. Not all jobs in 2136 are on shortage occupation.
it is important u do this correctly as your fee will depend on this answer.

Last time my employer got me the COS under SOC 2136 (Senior developer - SOC code 2136). I'm in the same position.

Now HR got changed in my organisation and the new HR applied under the normal category.

You don't need RLMT unless you change employer (or different SoC at same employer). Best to update the CoS.

To apply under Shortage occupation under 2136, the company has to gain prior permission before assigning CoS. It is called the qualifying company criteria and they must have between 10-250 employees and not more than 10 employees on that particular SoC code. There are some other criteria too mentioned in the guidance

I'm leading a team of 8 developers and got around 15+ years of experience. As you mentioned that's how my employer got me a COS under Shortage Occupation last time.

This time, my HR has followed the general route.

Thought I will check with moderators & users here in this forum before I can go back to my HR.

Hello

This is in continuation to the post.

I asked my HR to change the COS to reflect "Shortage Occupation List" some 4 weeks back. They came to me yesterday that Sponsorship is in being Suspended now for some reason and they have raised an appeal. So I wont be able submit my application.

They promised me that they have put their best effort to revoke the suspension but not sure how long this is going to take.

My visa is expiring early next month (July 217) and I so worried with no other options left.

what will happen if I submit my application? Will they reject it because (i) sponsorship is now suspended (ii) my earlier cos was under Shortage Occupation List and this time it is under normal route.

Will I get any information from UKBA?
