Tourist VISA after Dependent VISA

Post by siddheshk22 » Wed Apr 26, 2017 5:46 pm

Hello,

I am working in UK on STWP and I have my dependents here with me on Tier II Dependent VISA.
Now I am going back to India to get the VISA converted to LTWP. This will be extended by 3 years.
However my assignment here is only 10 months. And in light of the recent fee increase for Dependents VISA for Long term (1250 GBP) I am planning to get them here on Tourist VISA for 6 months.
The questions I have are -
1. Will they be granted Tourist VISA immediately after current Tier II Dependent VISA is over?
2. Will they be granted VISA when main applicant (me) has a VISA which is valid for a longer duration. Maybe till June 2019?

They have visited UK thrice before from Jan to Sept 2014 (On Tier II Dependent VISA), June to Dec 2016 (On Tourist VISA) and Jan to May 2017 (On Tier II Dependent VISA). On all these occasions I held a short term WP so it didnt matter. But now since application for tourist VISA will be immediately after going back on a different VISA and me holding Long Term VISA, these questions have arised.

Kindly help with the queries. Much appreciated. Thanks.

Visitor visa by definition means for a visit to UK. Your dependents will have to declare in their form about you. UKVI can easily link it to their past history and conclude that they are not here for a visit but to join you. Please be ready for a greater scrutiny of the application. You dependents have to conclusively prove in their application that will go back after their short stay in UK (which might be difficult when you are here in UK).
Personally, I think it's a risky proposition.

Thanks moonlight55. Your reply is much appreciated.

Yes, I would be
1. writing in the form that they are here to join me but since my stay is only 6 months they are opting for tourist visa
2. providing letter from office which states that my assignment is only for 6 months
3. providing school admission letter in home country along with letter which has granted leave for 6 months only
4. providing property papers which are on my wife's name in home country as a strong attachment to go back

With all these do you think the case looks something which they can consider?
The recent increase of 250% has really been cruel to me.

Many Thanks again.

My view - (1) & (2) will give them enough reason to tell that visitor visa is not the right type of visa for the dependents. I'll leave for the experts to comment.
