Help please.....dependent ILR

Post by hereandnow101 » Fri Apr 28, 2017 5:20 pm

Hi Everyone,

I have a doubt which I wanted to clear and would appreciate any feedback.

I entered the UK in July 2013 on a Tier 2 visa. My wife and children joined me in May 2014 as Tier 2 dependents. Following extensions, we all have leave to remain until July 2019.

My main issue is that I would be eligible for ILR on the 5year route in July 2018 (next year) but my family won't. I am wondering if I am able to apply for my ILR in 2018 and they still remain on Tier 2 dependent visa until May 2019 when they all complete their 5 year residence.

Is this appropriate and legal or do they have to change their visa type when I get ILR in 2018?

I would be grateful for your responses and it would be helpful if you can point me to any official document I can refer to, as I have checked for this information.

Thank you.

They can continue to extend their current visas if you apply for ILR under the 5 year route.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Many thanks Casa for your response.

Perhaps my next query would be.... Would my family be eligible for ILR after 5 years residency for them (i.e. In May 2019) since they have Tier 2 dependent leave to remain till July 2019

Also, does their residency clock reset if I change to ILR? If so, wondering if I should just wait so we all apply for ILR at the same time in May 2018.

Kindly advise

You don't have to wait. Your dependants may wait.
