Swicth from PHD TO T2, do I need to wait for 12 months?

Post by babalaxiaomoxian » Fri Apr 28, 2017 5:35 pm

Hello, everyone.

I just started my PHD degree for 3 months but I also got an offer from my dream company, now I want to withdraw from my PHD and switch to T2 visa.

I have found that, according to guidance from home office:

"you have successfully completed and passed a UK recognised bachelor’s or master’s degree; or UK Postgraduate Certificate in Education (PGCE) or Professional Graduate Diploma of Education (PGDE); or you have completed a minimum of 12 months’ study in the UK towards a UK PhD during your last grant of leave or period of continuous leave which includes your last grant of leave;"

My first question: What does that bold "or" mean? I have done a bachelor's degree and master's degree in the UK as well, does that mean I do not have to complete 12 months study towards a PHD and I can switch to T2 now?

My second question: If switch to T2 from T4 based on a PHD, do I have to withdraw from PHD before I submit my application to switch to T2 or I can still do my PHD while waiting for the outcome?

Thank you in advance for your answer!

Or.

You should not withdraw from your PhD program before they grant leave to remain under Tier 2 (General).

Thank you for your answer. Exactly I was asking the "or" in that context. To be specific, does that mean I can immediately apply for T2 visa without waiting for 12 months because I previously got a bechelor's and master's degree?

Yes. I think that you don't need to wait under 245HD. Do read the rules directly to confirm.
