Employer refuses to provide COS for permanent worker.

Post by Daniel8284 » Fri May 05, 2017 8:07 am

Hi,
I have been a permanent worker in a university for 4 years with Tier 2 Visa. My Visa due to expires end of this month. I was contacted by HR this Feb to fill some form in order to renew the COS. I replied immediately and got no reply until I went to them last week. The school manager said he couldn't sponsor me the COS because of the uncertainty of the school. He also said he is very happy with my job and it is not a job cut just because he can't sponsor me at this stage. He reminded me that I have to leave the country as my visa expires shortly.

I double confirmed it is not a job cut. Please give me some advice. Am I entitled for 3 months notice period? I can't find another job within 3 weeks and do I have to leave the country? I got a property and it is impossible to deal with it within 3 weeks. The manager insisted that he can't give the COS at this stage only because of the uncertainty of the school service. How should I protect my rights? Hope you could please give me some advice. Thanks.

In that case, I am afraid you can not do anything. You can go to citizen advice center for an advice.

unfortunately, i dont think there is much u can do besides trying to find a new sponsor.
In hindsight, you should have probably started the process earlier to see if there will be any problem in getting a cos. You could stay a max of 14 days after the expiry of your visa to apply for a new leave.
If you leave the country, u have 1 year of cooling off time to spend before you can apply for tier 2 again.
