Hello, I very much would appreciate some advice in the following the matter.my husband receive income-related Employment and Support Allowance, and in the (WRAG) group.I am applying for a spouse visa and we have determined that if he claim Carer's Allowance for somebody, we would be exempt from the financial requirements, However, we are concerned with a particular matter.
To fit within these rules and satisfy the requirements for a spouse visa, does Carer's Allowance have to be paid in full in order to be considered Carer's Allowance in actuality? What I mean by this is that because ESA is considered an overlapping benefit with CA, the actual amount (approximately £62.70) is removed and another amount (approximately £34.95) is paid instead. If he receive this £34.95, is it still counted as receiving Carer's Allowance and as a result being exempt from the financial requirements?
